1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website, platform, and services provided by PSS — Project Support Service ("PSS", "we", "us"). By accessing our website (pssmanagementfzco.com), using our Digital Twin viewer, submitting a project inquiry, or engaging our services, you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or organization, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not use our services. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance of the revised Terms.
2. Services
PSS provides industrial engineering services including but not limited to: LiDAR scanning and point-cloud capture, scan-to-BIM modeling, Digital Twin creation and hosting, integrity management, AR/VR field deployment, and edge/IoT integration for industrial facilities.
- All service engagements are subject to a separate proposal, statement of work, or master service agreement that defines scope, timeline, deliverables, and fees.
- You agree to provide accurate project information, site access, and any required facility data necessary for us to perform the services.
- We will perform services in a professional and workmanlike manner in accordance with industry standards for BIM (ISO 19650) and surveying accuracy.
- We reserve the right to refuse or suspend services if your use violates these Terms or applicable law.
Any timelines or delivery estimates are provided in good faith and may be affected by site conditions, client review cycles, or third-party dependencies.
3. Intellectual Property
All content on our website — including text, graphics, logos, software, Digital Twin demonstrations, and BIM sample models — is owned by PSS or its licensors and is protected by copyright, trademark, and other intellectual property laws.
- Client Deliverables: Ownership and licensing of project-specific deliverables (e.g., BIM models, point clouds, Digital Twins) is defined in the applicable service agreement. Typically, clients receive a license or assignment for their facility data upon full payment.
- PSS Platform & Methods: Our proprietary workflows, software tools, templates, and know-how remain the exclusive property of PSS.
- Restrictions: You may not copy, modify, reverse-engineer, or redistribute our platform or demonstration content without prior written consent.
- Client Materials: You retain ownership of materials, facility data, and existing models you provide to us. You grant PSS a limited license to use them solely to perform the contracted services.
4. Limitation of Liability
To the fullest extent permitted by applicable law, PSS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our website or services.
Our total liability for any claim arising out of or relating to these Terms or the services shall not exceed the total amount paid by you to PSS for the specific services giving rise to the claim in the twelve (12) months preceding the event.
- Digital Twin models, BIM outputs, and scan data are provided as engineering representations and should be validated for critical safety or construction decisions.
- Nothing in these Terms limits liability for fraud, willful misconduct, or where limitation is prohibited by law.
- You agree to indemnify and hold harmless PSS from claims arising from your misuse of the services or breach of these Terms.
